Parents' shock at car boot porn

Trading Standards officers are warning parents to be vigilant when allowing children to visit car boot sales after hardcore pornography was found on sale. The explicit material was being sold at Blakeston Lane car boot sale in Norton, Teesside, which is attended by hundreds of people, many with young children.Officers seized the DVDs, along with illegal copies of films currently on release at cinemas in the region.
Several stalls were selling the DVDs, according to Trading Standards. Stockton Council's licensing manager David Kitching said: "I am concerned that officers found this material on sale in full view of children.
"The sale of pornography requires a special licence and can only be sold at licensed sex shops.
"Some of the material may even be illegal in this country."(Source BBC October 2005)

Porn channel fined for broadcast

Ofcom was concerned children could have been watching the broadcast
Pornographic satellite channel Xplicit XXX has been fined £50,000 for broadcasting hard-core sex scenes before the 9pm watershed.
The channel is usually only available to subscribers after 2200 BST, but can run promotional videos earlier if they are not sexually explicit.
The company said it had accidentally transmitted the wrong tape, said BBC media correspondent Torin Douglas.
Ofcom said the channel had been "excessively complacent".
It is the first penalty imposed by media watchdog Ofcom since is started work at the beginning of the year.
Xplicit XXX told the regulator its usual scheduler was on holiday when the promotional tape was run as early as 2030 BST by another member of staff.
It said the employee had mixed up two tapes in identical containers, said our correspondent.
He said Ofcom had been concerned a child could have seen the material.
Ofcom had been considering imposing a six-figure fine, but limited it because the company was making a loss and no viewers had complained, he said. (Source BBC October 2005)

Hardore material is legal in the UK

To clarify it is now perfectly legal to buy, import and own consensual adult pornography in the UK. In September 2000 the British Board of Film Classification (BBFC) broke new ground by giving an R18 classification to videos containing the following previously banned content.

Aroused genitalia (erections);
Masturbation;
Oral/genital contact including kissing, licking and sucking;
Penetration by finger, penis, tongue, vibrator or dildo;
Non-harmful fetish material;
Group sexual activity;
Ejaculation and semen.

There is still no distinction between heterosexual and homosexual activity, although the following content is still not allowed...

Any material which is breach of the criminal law;
Abusive sexual activity such as incest or paedophilia;
The portrayal of any sexual activity, whether real or simulated, which involves lack of consent;
Infliction of pain, physical harm, sexual threats or humiliation;
The use of any physical restraints which prevent participants from withdrawing consent;
Penetration by an object likely to cause actual harm or associated with violence;
Degrading or dehumanising activity, such as bestiality, necrophilia, defecation or urolagnia.

So, for the first time in the UK we can legally view the same material which it has been possible to view on the Continent for decades. R18 videos can only be sold to over 18 year olds from licensed sex shops, of which there are approximately 90 in the UK.

(*) Note that although it is legal to buy, the seller may be liable to prosecution. (Even though the European Convention of Human Rights suggests that people cannot be prosecuted without justification of the harm that would otherwise result. And of course the authorities cannot ever seem to find the required proof).
